Golden Summer
Official Rules

Eligibility
Helium Mobile’s Golden Summer (the "Promotion") is open only to new and current Helium Mobile subscribers. Employees of Nova Labs, Inc. d/b/a/ Helium Mobile (“Nova”), its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the "Employees"), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Promotion. The Promotion is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
Agreement to Rules
The Promotion is governed by these rules and by the Helium Mobile Terms and Conditions (the “Rules”). The participant (“You”) agrees to be fully and unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Nova as final and binding as it relates to the Rules and the content of this Promotion.
Nova reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion should a virus, bug, non-authorized human intervention, fraud, or other cause beyond Nova’s control corrupt or affect the administration, security, fairness, or proper conduct of the Promotion. Nova reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Promotion or website or violates these Rules.
Entry; Rewards
All new and existing Helium Mobile subscribers will be automatically entered into the Promotion. Participants who sign up before September 1, 2024 and who meet certain performance thresholds that help validate and map the network are eligible to be selected to receive an airdrop from Nova of 5000 MOBILE at least once starting at 9:00 AM PT on June 21, 2024 through 11:59 PM PT on September 21, 2024 (the “Promotion Period”). Once selected, the participant becomes a “Golden Goose” for 60 minutes starting at time of selection. If the Golden Goose transmits data through a Helium Mobile Hotspot (the “Hotspot”) during that 60 minutes, the Hotspot will receive a Golden Egg NFT and an airdrop of 10,000 MOBILE. Golden Geese will automatically receive 5000 MOBILE into the Helium Mobile Wallet associated with the subscription at the end of the 60 minute period. Golden Hotspots, if any, will receive 10,000 MOBILE into the wallet associated with the Hotspot at the end of the 60 minute period for the relevant Golden Goose. Golden Geese will be selected every 60 minutes during the Promotion Period. CBRS radios and third-party hotspots are not eligible.
Golden Goose and Golden Hotspot rewards (the “Rewards”), including eligibility requirements, shall be solely determined by Nova. The Rewards are non-transferable. Any and all Rewards-related expenses, including without limitation, any and all federal, state, and/or local taxes, shall be the sole responsibility of the Golden Geese and Golden Hotspots. No substitution of Rewards or transfer/assignment of Rewards to others or request for the cash equivalent is permitted. Your acceptance of Rewards constitutes permission for Nova to use Your name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
Manual Opt-Out
If You would like to opt-out of the Promotion at any time, You can request to opt-out by emailing goldensummer@nova-labs.com with Your subscriber email address in the body and “Opt Out of Golden Summer” in the subject line.
Manual opt-out requests will be processed in the order they are received and may take up to three (3) weeks to take effect.
Rights Granted By You
By entering this content (e.g., photo, video, text, etc.), You understand and agree that Nova, anyone acting on behalf of Nova, and Nova’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Promotion, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.
Limitation of Liability
By entering, You agree to release and hold harmless Nova and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) Your participation in the Promotion and/or Your acceptance, possession, use, or misuse of any Rewards or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion, the processing of entries, and/or the processing and distribution of Rewards.
Disputes
THIS Promotion IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF NEW YORK, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. BY AGREEING TO THESE RULES, YOU AGREE TO ARBITRATE ALL DISPUTES. THIS MEANS HELIUM MOBILE AND YOU ARE BOTH WAIVING ANY STATUTORY AND CONSTITUTIONAL RIGHTS TO A JURY TRIAL. AS INDICATED ABOVE, YOU FURTHER AGREE THAT ALL DISPUTES UNDER THESE RULES SHALL BE GOVERNED BY THE HELIUM MOBILE DISPUTE RESOLUTION AND ARBITRATION PROCEDURES IN PART 34 OF THE HELIUM MOBILE TERMS AND CONDITIONS, INCLUDING MANDATORY INFORMAL DISPUTE RESOLUTION, AN ARBITRATION AGREEMENT AND WAIVER OF CERTAIN RIGHTS, AND WAIVER OF A JURY TRIAL, AMONG OTHERS.
The Promotion is hosted by Nova Labs, Inc. and is in no way sponsored, endorsed, administered by, or associated with any third party social network or platform.
