Privacy Notice

Applicability

This Privacy Notice explains how Nova Labs, Inc. and our subsidiaries and affiliates collect and use personal information. It applies to our Helium Mobile website, mobile app, and any other of our products, hardware and services (collectively, “Services”) that directly link to this Notice. This Notice does not apply where it is not linked. This Notice does not apply to our employees or contractors.

What Information We Collect

Depending on the nature of our relationship with you and how you choose to use the Services, we may collect the following information:

We collect account information. We collect information relating to your account. For example, we collect basic registration details like name, address and email address. We also collect your telephone number and username when you create an account.

We collect transaction and billing information. When you buy a product or purchase a subscription we collect billing information. This includes your form of payment and billing address. We collect other information about your use of your digital asset wallet. This includes information about digital asset types and balances. It may also include information about your wallet address and destination wallet.

We collect location information. We collect your zip code and state. Based on your IP address, we may also derive location information. If you enable certain features through the Services such as Discovery Mapping or other mapping Services, we collect precise location. This information helps support the Helium Network. We may also collect precise location information about your devices when you request troubleshooting or technical support for those devices.

We collect customer proprietary network information (CPNI). As a reseller of cellular services, certain information is generated by your use of our voice Services. This is information that relates to the type, quantity, destination, technical configuration, location, and amount of use of the voice Services. For example, this information includes the numbers called and date and time of calls. It also includes number of minutes on a call or information on your bill that relates to your voice Services. This information constitutes "CPNI." For more information on how we use CPNI and your choices, read the "Your Choices" section below.

We collect information about your usage of the Services and network. We collect information about your interactions with the Services. For example, for data sessions, when you send an SMS we collect source, destination, size, and date and time.

We collect device and performance information. We collect information about your device. This includes information about any connected third-party devices. The information we collect may include Internet speed, signal strength, error rates, length of connection time and other performance information. We may collect information about the quality of the wireless networks in your area. We may collect product serial numbers and other device identifiers such as IMEI numbers. For example, this might include your operating system and hardware model. We collect information about the browser or device you are using. This may include battery strength and other device analytics. We may look at what site you came from, or what site you visit when you leave us.

We collect feedback and other voluntarily provided information. We collect information that you give us when you complete a survey or participate in a contest or promotion. This includes when you write a review or make a suggestion. It also includes your communications with our customer service team.

We collect job application information. If you apply for a job, we collect information about you, your prior education and work history. We collect your resume and information about your skills and qualifications for the position.

How We Use Information

Now that you know what we collect, we want to tell you why and what we do with that information. Below we explain how we use information:

We use information to communicate with you. We use information to respond to your questions, including questions about our Services or your relationship with us. We also use information to communicate with you about this Notice or our Terms. We may also contact you about your feedback. We use information to send you alerts and other notifications. If you apply for a job with us, we use that information to process your application.

We use information to provide and improve our Services. We use information to process your order and to provide the Services. For example, to connect you to the network and route communications. We also use information to develop and improve our Services. For example, by saving certain preferences you choose. This information helps to customize your experience and analyze trends.

We use some information for marketing purposes. Where permitted by law, we use your information to share updates about new products and special offers, including promotions, surveys, and contests. This may include new features and updates. These might be our own offers or products or select third-party offers or products we think you might find interesting. This includes serving you with content on our platforms or on social media platforms. This may occur after you leave our sites or platforms and may encourage you to return. We may also serve ads that we think are relevant to you based on your browsing habits.

We use information to protect our company and users. We use information to protect our company and users, for example to identify fraud and secure, protect accounts, and protect Nova. This includes looking into potentially prohibited or illegal activity. We also use information to verify your identity.

We also use information as otherwise permitted by law or as we describe to you.

How We Collect Information

Like many other companies, there are different ways that we collect information. We have outlined them below:

We collect information directly from you. You might provide us information in several ways. For example, we collect information when you create an account or register a device. We also collect information when you make a purchase, contact us, or participate in a survey. We collect any other information you voluntarily provide to us when using the Services.

We collect information passively. We collect information about users over time and across different websites and apps. We also work with third parties that collect personal information this way. We may use several common tracking tools to collect information. Tracking tools include browser cookies and web beacons. To learn more about cookies visit the FTC's Online Tracking page. We may work with others to gather information on our platforms and elsewhere. We may do this on our websites and in emails that we send to you.

We collect information about you from others. Business partners may provide information about you to us. We may also collect information about you from other account holders and subscribers.

We Combine Information

We combine information that we have collected offline with information that we collect online as permitted by law. We combine information we have collected across other third-party sites. We combine information collected across devices, such as computers and mobile devices. We also combine information that we get from a third party with information we already have.

You may not use any scraper, crawler, spider, robot, or other automated means of any kind to access or copy data on the Site, deep-link to any feature or content on the Site, bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the Site.

Violations of system or network security may result in civil or criminal liability. Company will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations. You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of this Site or any activity being conducted on this Site.

When We Share Information

As part of our business there are times that we share information with others. You can find out more about that here:

We share information within our family of companies. This includes current and future affiliates and subsidiaries.

We share information with our service providers. We may share information with trusted companies who serve as our vendors and help us deliver and operate our Services. Examples of service providers include sending marketing communications, sales support, and customer support. Certain anonymized information (including, but not limited to, coarse location) may be shared with these kinds of vendors for purposes of providing the Services. These Vendors will not resell or use your data other than for the purpose of providing the services.

We will share information if we think we have to in order to comply with the law or to protect ourselves. For example, we will share information to respond to a court order or subpoena or if a U.S. or non-U.S. law enforcement agency, government agency, or investigatory body requests it. We may also share information we collect when we investigate potential fraud, abuse, or other similar violations of our terms. We may need to share information in an emergency.

We may share information with any successor to all or part of our business. If all or part of our business is sold, we're part of a merger or acquisition, or there is financing or bankruptcy, we may share information as part of that transaction.

We may also share information for other reasons we may describe to you or as permitted under law.

Your Choices

You have certain choices about how we use your information. Those are described here:

You can opt out of certain marketing. To stop receiving our promotional emails follow the instructions in any promotional message you get from us. If you opt out of getting marketing messages, you will continue to receive non-marketing messages from us about your relationship with us where permitted by law. For example, messages about technical updates and security.

Your choices around CPNI information. Under federal law, you have the choice to approve or disapprove certain uses of your CPNI (defined above) that are outside the scope of Nova's use for ordinary business operations, fraud prevention, or legal compliance. We may use CPNI for marketing our other Services to you. We may also share your CPNI among our affiliates or subsidiaries to offer you services different from the services you currently purchased. If you don't want your CPNI used for the affiliate and subsidiary sharing purposes described here, or for marketing of our other Services, please notify us by contacting Customer Service or by sending a written notice to support@hellohelium.com. Unless you notify us in one of these ways, we may use your CPNI as described above beginning 30 days after the first time we notify you of this CPNI policy. This would be 30 days after you purchase a subscription for voice Services. Your choice will remain valid until you notify us that you wish to change your selection. Your decision about use of your CPNI will not affect the provision of any services you currently have with us.

You can control certain settings on your mobile device or account settings. For example, you can turn off the location services or push notifications on your phone. To modify the push notifications you get from us, you can change your preferences in settings. To stop sharing your location and stop earning MOBILE, turn off the "Mapping" feature in the Helium app. You also can modify app level permissions, such as location collection, through your device settings. If you turn off "Mapping" in the Helium app, location services may still be through your device settings unless you change your device settings.

Our Cookie and Ad Policy

You can control cookies and tracking tools. Your browser may give you the ability to control cookies or other tracking tools. How you do so depends on the type of tool. Certain browsers can be set to reject browser cookies. The Self-Regulatory Program for Online Behavioral Advertising provides consumers with the ability to manage certain choices online here and provides a tool for managing mobile choices here. If you block cookies, certain features on our sites may not work. If you block or reject cookies, not all of the tracking described here will stop.

Our Do Not Track Policy: Some browsers have “do not track” features that allow you to tell a website not to track you. These features are not all uniform. We do not currently respond to those signals. If you block cookies, certain features on our sites may not work. If you block or reject cookies, not all of the tracking described here will stop. Options you select are browser and device specific.

You May Have Certain Additional Rights

In some places laws grant residents certain additional rights. You can reach us using the contact information listed in the “contact us” section below. 

Right to inquire and request deletions. Depending on where you live, you may have certain rights related to the information we collect about you. This includes the right to ask us what information we collect and use. It also includes the right to ask us to delete information we have collected from you. If you delete your account, you may not be able to use the Services. To exercise these rights, contact us at support@nova-labs.com. We will verify your request by matching information you provide us with information we have about you. If you are submitting on someone else’s behalf we may ask for additional information. This may include providing a signed letter verifying your right to make this request.

We Store Information in the United States

Information we collect is stored in the United States. The Services are intended for people who are in the United States. If you live outside of the United States and choose to use the Services you understand that it is at your own risk. If you live outside of the US, you understand and agree that we may transfer your information to the US. Our sites and businesses are subject to US laws, which may not afford the same level of protection as those in your country. By submitting your information, you agree to the processing of it in the US.     

Children’s Privacy

The places where this notice appears are meant for adults. We do not knowingly collect personal information from children. If you are a parent or legal guardian and think your child has given us information, you can write to us or email us at the addresses provided at the end of this notice. Please mark your inquiries “Parental Information Request.” Parents, you can learn more about how to protect children’s privacy here

How We Protect Information

We use reasonable security measures as required by relevant law. As a carrier under federal law, you have the right, and we have a duty, to protect the confidentiality of your CPNI. The Internet is not 100% secure. We cannot promise that your use of our sites will be completely safe. We encourage you to use caution when using the Internet.

Third-Party Services and Sites

We may link to third-party sites. Third party apps or platforms may also feature our services. Our sites may also include third party content that collects information. We do not control these third parties. This Policy does not apply to the privacy practices of those entities. Please read their privacy policies carefully. We are not responsible for the practices of these third-parties.

Updates

From time to time we may change our privacy notice. We will notify you of any material changes to our notice as required by law. We will also post an updated copy on the places where this appears. Please check periodically for updates.
